SUBJECT: DONATIONS OF MERCHANDISE

QUESTION PRESENTED

What is the propriety of a law firm donating upon request some type of merchandise to the COMBO sale (a sale by a nonprofit organization to raise money for the performing arts)?

CONCLUSION

The donation can be made in the name of one of the attorneys without a designation that he or she is an attorney. The donation should not be made in the name of the firm.

EDITOR'S NOTE: This opinion was reviewed July 26, 1976 and found to be valid as it relates to a donation of merchandise. Ethics Opinion 1974-19 subsequently held that a donation of legal services is prohibited as a solicitation of employment.
